How to Draft a Rent Agreement in India: What to Include

A rent agreement is the legal document that protects both landlord and tenant — it's also what you'll be asked for when claiming HRA tax exemption, applying for local address proof, or resolving a dispute. A vague or missing agreement leaves both sides with no clear reference if something goes wrong.

What every rent agreement should include

  • Full names and addresses of landlord and tenant
  • Property address and a description of what's included (furnishing, parking, amenities)
  • Monthly rent amount, due date, and accepted payment method
  • Security deposit amount and the conditions for its return
  • Lease duration and renewal terms
  • Maintenance responsibilities — who pays for what repairs
  • Notice period required before either party can terminate the agreement

The 11-month convention, and why it exists

Many Indian rent agreements run for exactly 11 months instead of a full year. This isn't a legal requirement — it's a common way to avoid the mandatory registration requirement that applies to leases of 12 months or longer under the Registration Act, since registration adds cost (stamp duty) and paperwork. An 11-month agreement is typically renewed (or a fresh one signed) after it lapses.

Stamp duty and notarization

Rent agreements are usually executed on stamp paper of a value set by the state, then either notarized or registered depending on state rules and the lease duration. Requirements and stamp duty rates vary meaningfully by state — check your specific state's current rules before finalizing, since what's standard in one state may not apply in another.

Rent receipts are a separate document

The rent agreement establishes the terms; monthly rent receipts are what you actually submit to claim HRA exemption when filing taxes. Keep both — the agreement alone isn't sufficient proof of rent actually paid each month.

Getting it right from the start

Templates are a reasonable starting point, but a rent agreement is a legal document — for anything beyond a straightforward residential lease, or if either party wants extra protection (a clause on subletting, specific maintenance obligations), it's worth having it reviewed rather than relying purely on a generic template.
