When someone passes away, their bank account, pension, insurance policy or property doesn't transfer to the family automatically — most institutions ask for a legal heir certificate first, to confirm exactly who the rightful heirs are. What is a legal heir certificate actually for?

It's issued by the Tehsildar or Revenue Officer and lists every surviving legal heir of a deceased person — usually the spouse, children and parents. Banks use it to release a deceased account holder's balance, insurers use it to pay out a claim, and pension offices use it to transfer family pension. It's a routine administrative document, not a court order.

Legal heir certificate vs succession certificate

These get confused constantly, and using the wrong one wastes weeks. A legal heir certificate (Tehsildar-issued) is enough for straightforward transfers — a bank account, provident fund, salary dues, a small insurance payout. A succession certificate (issued only by a civil court) is required for anything more contested or valuable — transferring shares, debentures, debts owed to the deceased, or when heirs disagree on the split. If a bank specifically asks for a succession certificate, a legal heir certificate won't be accepted as a substitute.

Who counts as a legal heir?

  • Spouse of the deceased
  • Children (sons and daughters, including adopted children where recognised)
  • Parents, if the deceased had no spouse or children
  • In some cases, siblings — depending on applicable personal law and whether closer heirs exist

Documents you'll need

  • Death certificate of the deceased
  • Aadhaar and address proof of all legal heirs
  • Ration card or family register showing the family structure
  • A self-declaration affidavit listing every heir and their relationship
  • Proof of relationship — birth or marriage certificates — if asked

Step-by-step: how to apply

  1. Go to your Tehsildar/Taluk office, or check if your state's e-District portal (Mee Seva, e-Sevai, and similar) allows online filing.
  2. Submit the death certificate, an affidavit naming every legal heir, and supporting ID/address proofs.
  3. A Village Administrative Officer or Revenue Inspector typically verifies the details, sometimes with a local enquiry.
  4. The Tehsildar signs off on the certificate once verification is complete.
  5. Use the certificate with the bank, insurer or registrar that requested it.
One heir can file the application, but list every legal heir in the affidavit — leaving someone out is the single most common reason these certificates get challenged later.

How long does it take, and what does it cost?

Processing usually takes 15–30 days after verification, longer if there's a family dispute or the Revenue office needs an additional local enquiry. The fee itself is small — typically ₹20–100 plus affidavit and stamp paper costs — but it varies by state, so check your local Tehsil office or e-District portal for the exact amount.
