Search the existing trademark database on the IP India portal to check your mark isn't already taken or too similar to one.
Choose the correct class(es) — one of the 45 NICE classification classes matching your goods/services.
File Form TM-A online with the mark, applicant details and class(es) selected.
The Registry examines the application; if there's an objection, you respond within the given deadline.
If cleared, the mark is published in the Trade Marks Journal for a 4-month opposition period.
If no one opposes it (or the opposition is resolved in your favour), the trademark is registered and a certificate is issued.
Official fees
₹4,500 per class for individuals/startups/MSMEs (with valid Udyam certificate); ₹9,000 per class for other companies, filed online.
Processing time
Typically 12–24 months end-to-end if unopposed; can take longer if objected to or opposed.
Validity
10 years from the filing date, renewable indefinitely in further 10-year terms.
